By accessing or using Vowch services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all users of our platform, including business clients and their customers who receive celebration messages.

Program Description
Vowch is a celebration messaging service that enables businesses to send personalized photo messages to their customers via SMS and email. When a business captures a celebration moment (such as a vehicle purchase, home closing, pet grooming, orthodontic milestone, or other special occasion), they can use our platform to instantly deliver professional photos to their customers.
Message Frequency
Messages are sent only when a celebration is captured by the business. The frequency of messages varies based on your interactions with participating businesses. You will only receive messages when a business specifically sends you a celebration photo. This is not a recurring subscription service.
Message and Data Rates
Message and data rates may apply. Standard messaging rates from your mobile carrier will apply to SMS messages sent through our service. Please contact your mobile carrier for details about your messaging plan and any applicable charges.

How to Opt Out
You can opt out of receiving messages at any time by:
- Texting STOP to any message you receive from us
- Replying to any message with the word STOP
- Contacting us directly via email or phone using the support information above
After you send the STOP command, you will receive one final confirmation message letting you know that you have been unsubscribed. You will not receive any further messages from us unless you opt back in.
Supported Carriers
Our SMS service is supported by all major U.S. mobile carriers, including AT&T, T-Mobile, Verizon, Sprint, and others. For a complete list of supported carriers or if you experience issues receiving messages, please contact our support team.
Use of Services
Eligibility
You must be at least 13 years of age to use our services. By using Vowch, you represent and warrant that you meet this age requirement.
Account Responsibilities
Business clients are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to notify us immediately of any unauthorized use of your account.
Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to:
- Send unsolicited or spam messages
- Upload or transmit malicious content or code
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Use the service to harass, abuse, or harm others
- Attempt to gain unauthorized access to our systems
Intellectual Property
The Vowch platform, including all software, designs, text, graphics, and other content, is owned by Vowch and is protected by copyright, trademark, and other intellectual property laws.
Business clients retain ownership of the photos and content they upload to our platform. By uploading content, you grant us a license to store, process, and deliver that content as necessary to provide our services.
Privacy and Data Protection

Service Availability and Modifications
We strive to provide reliable service, but we do not guarantee that our services will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.
We may also update these Terms and Conditions from time to time. Your continued use of our services after any changes constitutes acceptance of the updated terms.
Disclaimers and Limitation of Liability
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOWCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
Indemnification
You agree to indemnify, defend, and hold harmless Vowch and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these terms, or your violation of any rights of another party.
Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising out of or related to these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for violations of intellectual property rights.
Termination
We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.
